Weir Terms of Service

Weir is currently in development and not yet available for installation. These terms will apply when Weir becomes available on the Atlassian Marketplace. Please read them before using Weir. By installing or using Weir, you agree to them.
1. Acceptance
Using Weir means you accept these Terms of Service. If you don't agree, please uninstall the app.
These terms apply alongside Atlassian's Marketplace Terms of Use and your organization's own Jira agreements. In the event of a conflict, Atlassian's Marketplace Terms take precedence over these terms to the extent required.
2. License
Aquarium Apps grants you a non-exclusive, non-transferable, revocable license to use Weir solely through Atlassian Marketplace on Jira instances you are authorized to access. This license does not include the right to redistribute Weir.
3. Billing
Weir pricing will be determined prior to launch and published on the Atlassian Marketplace listing. All billing will be handled by Atlassian Marketplace. Aquarium Apps will not process payments or store payment information. Refunds will be governed by Atlassian's Marketplace refund policy - contact Atlassian support for billing disputes.
4. Permitted use
You may use Weir for legitimate capacity planning and sprint workload management on Jira instances where you have authorization to access project and sprint data. Weir is intended for use by team leads, project managers, and teams planning work against Jira sprints.
5. Prohibited use
You may not:
- Reverse engineer, decompile, or attempt to extract Weir's source code
- Use Weir in a way that abuses or exceeds Jira API rate limits, or that interferes with other users on your Jira instance
- Use Weir for any purpose that violates Atlassian's Cloud Terms of Service or Marketplace Terms of Use
- Resell or sublicense access to Weir
6. Your data
You own your data. Weir reads sprint and issue data from Jira's APIs but does not copy it to any external system or claim any rights over it. All Jira data remains in your Jira instance.
App-specific configuration (availability settings, capacity rules) stored in Forge Storage is associated with your Jira instance and account. See our Privacy Policy for full details on what is stored and how to export or delete it.
7. Warranty disclaimer
Weir is provided "as is" without warranties of any kind, express or implied. We make no guarantees about uptime, accuracy, or fitness for a particular purpose. No uptime SLA is offered. Availability is subject to Atlassian Forge platform availability.
8. Limitation of liability
To the maximum extent permitted by law, Aquarium Apps' total liability to you for any claim arising out of or relating to Weir or these terms is limited to the fees you paid for Weir in the twelve months preceding the claim. Aquarium Apps is not liable for indirect, incidental, special, or consequential damages, even if advised of the possibility.
9. Governing law
These terms are governed by the laws of the United States. Any disputes will be resolved in a court of competent jurisdiction in the United States.
10. Changes to these terms
We may update these terms from time to time. We will post changes at aquariumapps.io/weir/terms. For material changes, we will provide at least 30 days' notice before the new terms take effect. Continued use of Weir after that date constitutes acceptance of the updated terms.
