Fathom Terms of Service

Please read these terms before using Fathom. By installing or using Fathom, you agree to them.
1. Acceptance
Using Fathom means you accept these Terms of Service. If you do not agree, do not install or use the software.
2. License
Fathom is free and open-source software released under the MIT License. You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software, subject to the MIT License terms included in the source repository. No payment, account, or registration is required.
3. Permitted use
You may use Fathom for any lawful purpose, including personal use, commercial use, and integration into your own tools or workflows. You may modify the source code and distribute your modifications under the terms of the MIT License.
4. Prohibited use
You may not:
- Use Fathom in a way that violates applicable laws or regulations
- Distribute modified versions of Fathom in a way that removes or misrepresents the original MIT License attribution
- Use the Aquarium Apps name or branding to imply endorsement of a derivative product without permission
5. Your data
Fathom runs entirely on your local machine. All data it collects is written to your local filesystem and is never transmitted to Aquarium Apps or any third party. Aquarium Apps has no access to your session data, token counts, cost figures, or any other information Fathom records. You own your data completely.
Because Fathom operates locally and sends no data anywhere, there is nothing for Aquarium Apps to delete, export, or process on your behalf. To remove your Fathom data, delete the files in ~/.fathom/ on your machine.
6. Warranty disclaimer
Fathom is provided "as is," without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement. The entire risk as to the quality and performance of Fathom is with you. This is standard for MIT-licensed open-source software.
7. Limitation of liability
To the maximum extent permitted by law, Aquarium Apps shall not be liable for any indirect, incidental, special, exemplary, or consequential damages arising out of or relating to your use of Fathom, even if advised of the possibility of such damages. Because Fathom is free software, Aquarium Apps' total liability for any claim arising from its use is zero dollars.
8. Governing law
These terms are governed by the laws of the United States. Any disputes will be resolved in a court of competent jurisdiction in the United States.
9. Changes to these terms
We may update these terms from time to time. Changes will be posted at aquariumapps.io/fathom/terms. For material changes, we will provide notice before the new terms take effect. Continued use of Fathom after that date constitutes acceptance of the updated terms.
